Mr B was a life long train enthusiast and spent his entire life working for British Rail. Unfortunately he was exposed to asbestos during his early years of employment whilst working on steam trains in the 1960s. Following his diagnosis with mesothelioma, he instructed Hugh James to investigate a claim on his behalf.
Sadly, Mr B passed away shortly afterwards and the claim was continued by his family, including his widow who has extensive care needs, the majority of which her husband used to provide.
Hugh James obtained expert evidence from a consultant geriatrician as well as an extensive report from a qualified nurse in order to fully detail all of Mrs B’s care needs. Settlement negotiations were then entered into with the Department of Transport, who retain the liabilities of British Rail. Ultimately, settlement was agreed in the sum of £340,000 which incorporated a significant sum in relation to Mrs B’s on going care needs that were previously provided by her husband.
