Supplier liability and the battle of the forms
Matthew Stevens looks at the decision in the recent case of BDW Trading Ltd v Lantoom Ltd and considers how a supplier can be found liable for supplying materials not suitable for their intended use. Matt also discusses the age-old issue of “battle of the forms” – purchase order v delivery note – and which terms and conditions takes precedent, as well as the approach taken by the court when making their decision.
