How do I know I have a claim against my barrister?
We understand how daunting the prospect of bringing a claim against a negligent barrister can be. Barristers are highly qualified professionals and are often instructed to act in a variety of complex matters particularly in relation to conducting a case in court; or when seeking specialist advice in a complex area of law. Whilst in the majority of cases clients are satisfied with the level of professionalism conducted by the barrister, occasionally they make mistakes which can prove costly to their clients.
There are a number of situations where a barrister may have been negligent, including:
- providing negligent advice (such as to settle a claim for less than it is worth, or to continue to fight a hopeless claim resulting in you incurring significant costs)
- missing court deadlines resulting in your claim being struck out
- negligently drafting documents
- conducting their advocacy in court negligently
